SunSetter Recall Lawsuit

Have you been injured by a SunSetter awning? You may be entitled to file a SunSetter lawsuit. Over 200k units were recalled due to injury, and one death.

(Sept. 18, 2019) A series of vinyl covers for SunSetter motorized awnings have been recalled because the bungee cover used to secure them can cause major issue upon removal.

The problem with the awning is when the cover is removed, it causes the awning to unexpectedly open and strike anyone in its path with enough force to cause serious injury or death. The company has received 14 reports of injuries, including one death.

A 73-year-old man died after the cover struck him while he was removing the bungee tie-downs. He was standing on a ladder on his balcony when the cover hit him; he fell off the balcony and unfortunately died.

The recall affects roughly 270,000 units in the United States, stemming all the way back to models from 1999.

According to the recall on the Consumer Product Safety Commission, the following soft vinyl models (manufactured between 1999 and 2019) are affected in conjunction with:

  • SunSetter Motorized
  • Motorized XL
  • Motorized PRO
  • Motorized PROXL
  • Oasis Freestanding Motorized Retractable Awning

Consumers are asked not to install (or attempt to install) the covers for the motorized awnings, or remove the covers until they receive instructions from SunSetter.

Owners are asked to contact SunSetter for a set of free breakaway clips that replace the bungee tie-downs that have prompted the awning to break away and strike a person.

The recalled SunSetter covers sold for about $100, or were included as part of promotional sales of motorized awnings. Consumers may have purchased them from distributors nationwide, SunSetter, or Costco Wholesale between June 1999 and January 2019.
