Johnson//Becker, PLLC filed a lawsuit against the Pennsylvania Higher Education Assistance Agency alleging call center employees were not paid for booting up and logging into their work computers and programs to make themselves call-ready. The lawsuit was filed on Sept. 19, 2023.

The Pennsylvania Higher Education Assistance Agency, a student financial aid service provider, is a domestic nonprofit corporation that operates a call center and employs onsite and remote customer service employees.

According to the Complaint, Ms. McCarthy regularly worked over 40 hours per workweek without overtime pay for all hours worked. Each workday, Ms. McCarthy would boot up her work computer and log in to multiple programs, servers, and applications. The Complaint states that Defendant does not compensate call center employees for this boot-up and call-ready work.

Federal law mandates that work performed over 40 hours in a workweek must be compensated for at one and one-half times the employee’s regular rate of pay.

A resident of Harrisburg, Pennsylvania, Ms. McCarthy is represented by Johnson//Becker lawyers Zackary S. Kaylor and Jacob R. Rusch. Mr. Rusch and Mr. Kaylor have extensive experience handling plaintiff’s employment law cases, focusing on collective actions under the Fair Labor Standards Act.
