The majority of the workforce at RxC Acquisition Company’s call center consists of staffing placements from the company Does 1-10.

According to the Complaint, Ms. Hernandez regularly worked over 40 hours per workweek, which included conducting boot-up and call-ready work. Before she could take calls from clients at her regularly scheduled shift start time, Ms. Hernandez was required to boot up the computer and computer applications to make herself call-ready. The Complaint also alleges that the boot-up and call-ready work regularly takes up to 10 minutes per shift, sometimes more if technical issues arise.

Federal law mandates that work performed over 40 hours in a workweek must be compensated for at one and one-half times the employee’s regular pay rate.
