Johnson//Becker, PLLC is a nationwide FLSA law firm with extensive experience representing employees in lawsuits against employers who fail to compensate workers in accordance with federal and state laws. The firm has recovered millions of dollars in settlements for affected employees.
Johnson//Becker filed a lawsuit against Safeway Insurance Company, alleging call center employees were not paid for booting up and logging into their work computers and programs to make themselves call-ready. The lawsuit was filed on Oct. 13, 2023, on behalf of Ms. Apieczonek.
Safeway Insurance Company is a family-owned insurance company dealing with automobile insurance policies and other customer issues. The company operates a customer service call center.
According to the Complaint, Ms. Apieczonek regularly worked over 40 hours per workweek. Before she could start taking calls from customers, Ms. Apieczonek turned on her computer, booted up several programs and applications, and logged in to said programs and applications. Once everything was logged in, Ms. Apieczonek would log in to the phone system to take the first call at her shift start time. According to the Complaint, the time spent booting up and logging into the computer and several programs was not compensated for by Defendant.
Federal law mandates that work performed over 40 hours in a workweek must be compensated for at one and one-half times the employee’s regular rate of pay.
A resident of Illinois, Ms. Apieczonek is represented by Johnson//Becker lawyers Zackary S. Kaylor and Jacob R. Rusch. Mr. Rusch and Mr. Kaylor have extensive experience handling plaintiff’s employment law cases, focusing on collective actions under the Fair Labor Standards Act.
